Refund Policy

This Refund & Cancellation Policy (the “Policy”) governs the conditions under which refunds, cancellations, and rescheduling may apply to the services provided by CyberPrime8. This Policy forms an integral part of the Terms & Conditions and is incorporated therein by reference.

1. Nature of Services

CyberPrime8 provides advisory, executive consultation, coaching, and strategic IT & cybersecurity services.

All Services are:

  • professional and advisory in nature,

  • delivered under a best-effort obligation,

  • based on time, expertise availability, and intellectual contribution.

No results or outcomes are guaranteed.

2. Online Consultations & Executive Sessions

Payment

All online consultations, executive sessions, and coaching calls are payable in advance at the time of booking.

Rescheduling

  • One (1) reschedule is permitted free of charge if requested at least 24 hours before the scheduled session.

  • Additional rescheduling requests may be refused or billed.

Cancellations & No-Shows

  • Cancellation more than 24 hours before the session:
    → Full refund, minus non-refundable payment processing fees, or credit upon request.

  • Cancellation less than 24 hours, no-show, or arrival more than 10 minutes late:
    → No refund. The session is considered delivered.

3. Coaching Programs & Subscriptions

Coaching programs (including multi-session or time-based engagements) are reserved capacity commitments.

  • No refunds are issued once the program has started.

  • Unused sessions are not refundable and cannot be transferred.

  • Missed sessions due to Client unavailability are considered delivered unless otherwise agreed in writing.

4. Advisory Engagements & SOW-Based Services (B2B)

For services provided under a Statement of Work (SOW):

  • Refund terms, if any, are governed exclusively by the SOW.

  • Unless explicitly stated otherwise in writing, fees paid are non-refundable once the engagement has started.

  • Early termination does not entitle the Client to a refund of fees already invoiced or paid.

5. Consumer Right of Withdrawal (EU Only)

Where applicable under EU consumer protection laws, individuals acting outside a professional or commercial activity may benefit from a 14-day statutory right of withdrawal for distance purchases.

Conditions

  • If withdrawal is exercised before the Service starts:
    → Full refund, minus non-refundable processing fees.

  • If the Client expressly requests the Service to begin during the 14-day period:
    → The Client agrees to pay a pro-rata amount for Services already performed.

  • Once the Service is fully performed, the right of withdrawal no longer applies.

6. Exceptional Circumstances

Refunds outside the conditions described above are granted solely at CyberPrime8’s discretion and only in exceptional circumstances.

Dissatisfaction with results, outcomes, or business impact does not constitute grounds for a refund.

8. Governing Law

This Policy is governed by French law. Any dispute relating to refunds or cancellations shall fall under the exclusive jurisdiction of the courts of Nice, France.
